Indentures at Historical Society of Shawangunk & Gardiner

 

·         May 5, 1722 – Colonel Jacob Rutsen to Nicolas Roosa
Colonel Jacob Rutsen of Rosendale conveyed to Nicolas Roosa of Hurley half of a tract called Nescotack being part of the land called by Patent Guilford adjourning the land of Joseph Hasbrouck previously occupied by Hendrick Van Weye Cabe of Guilford deceased. Roosa’s payment was to be ¼ of all grains raised and delivered to the Grist mill in Rosendale.

 

 

 

 

 


 

 

LOOSE TRANSCRIPTION:

This indenture made the fifth day of May in the Eighth year of the Reign of our soveraign Lord George by the grace of god of Great Brittain France and Ireland King defendor of the faith of Annoys Dom one thusand seven hundred and twenty two Between Col Jacob Rutson of Rosendale in the county of Ulster Eagl of the one part and Nicolus Roosa of the Township of Hurley in the County aforsaid, Wittnesseth that the said Col Jacob Rutsen Hath promised sell to farms Letten and ;by these present doth demise sell and to farm Lett unto the said Nicolas Roosa his Execution administrators the ons Maiely or Just halfe of all the Certain tract or parcell of Land Called by the Jordian name of Nescotack being part of the land Called by Patent Guilford that is to lay the just halfe of said Land belonging tunto Col Rutsen next adjorging to the Land of Joseph Hasbruck Engle so as the farms has formerly been in the pwsetion and occupation of Hendrick Van Weye Cabe of Guilford afore of his widdow since his decease together with all and singular the buildings, fencing and other the penips and appurtenances unto the same just halfe of said land of the above name Col Rutsen belonging or in any wise appurtaining or therwithall also occupied of enjoyed as part parcel or member of the same To have and to old the above mentioned moiely or just halfe of said land - and premises with the appartenances of every part parceel thereof unto the said Nicolas Roosa his executors administrators for and during the full term and space of Eighteen whol years......

august now next ensueing and to Continue till said terms cofilly Expire Confileased and its is further agreed by and between the parties above naed that all the land that said Nicolas Roosa shall Clear Culkbale and Improve shall unto his own trogress use benefitt and Chosfe durng the terms aforsaid and is to have the Liberty to sow so much flax seed as for his families use shall be conveniet during the terms aforesaid, In Consideration where of the siad Nicklos Roosa his Executors and administrators or assigner is to pay and deliver unto the Coll Rutsen his Executors and Administrators of assignees the fouth of all grains that shall be raised on the said Land yearly and Every year to be housed thrashed cleaned and delivered free of all Charges at Rosendale aforsid in the Grist mill of him the Said Coll rutsen except only of the Land he Clears and Improves as aforesaid and it is further agreed by and between the parties aforesaid that all what said Nicolas Roosa his Executors and administrators or assignees shall improve on said Demised Land by fencing clearing building or other wise shall be vallues at the End of the terms aforesaid that then the said Coll Rrusen his Executors or administrators shall pay and satifize unto these said Nicllas Roosa his executors or administrators What said Improvement shall be vallued, apraised to be better as it was att the beginning of said Terms in Wittness - where of the partie first above named to these present Indentures hath hereunto just his hand and seale the day and yueare first above written
